Stuart T. O'Neal, III

Stuart T. O’Neal is a Member at Burns White and is based out of the firm’s Philadelphia office.

Mr. O'Neal's practice focuses on the defense of medical facilities, long-term care facilities and professionals of all types. He handles various professional liability and general liability matters in state and federal court, and has represented providers of all sizes at the administrative level. Mr. O’Neal also manages a variety of commercial, employment and contractual disputes, and has been called upon by clients to handle internal investigations centered on the misappropriation of funds, embezzlement and internal audits.

In addition, Mr. O'Neal advises and defends institutions throughout the state involving a wide variety of corporate liability issues and lectures extensively on this topic.

Mr. O'Neal is a mediator with the American Health Lawyers Association, a Judge Pro Tem in Philadelphia County and a mediator in Montgomery County. He is also a Board Member and past President of the Professional Liability Defense Federation (PLDF), an organization based in Minneapolis, Minnesota that is comprised of more than 335 members.

Additionally, Mr. O'Neal was named to the Pennsylvania Health Care Association (PHCA) and their companion organization the Center for Assisted Living Management's (CALM) Tort/Liability Committee, where Burns White serves as tort counsel. Mr. O'Neal, in that capacity, assists the committee in drafting and formulating legislative initiatives. Mr. O'Neal also assisted in drafting the Amicus Brief on behalf of PHCA, CALM, LeadingAge PA, and the American Health Care Association to the Pennsylvania Supreme Court to fight the extension of corporate liability to certain health care providers and their corporate entities.

Mr. O'Neal obtained his undergraduate degree from Dickinson College and his Juris Doctorate from the Villanova University School of Law. While at Villanova Law, a case note drafted by Mr. O'Neal about the regulations affecting the petroleum refining industry was selected for publication.

Mr. O'Neal was named to the Pennsylvania Super Lawyers® list  in 2012, and to the Pennsylvania Super Lawyers®  "Rising Stars" lists from 2010-2011. Mr. O'Neal is licensed to practice law in the Commonwealth of Pennsylvania, the U.S. District Court for the Middle District of Pennsylvania and the U.S. District Court for the Eastern District of Pennsylvania.
